These Terms & Conditions (“Terms”) govern all past, present, and future engagements between Fix My Digital (“we,” “us,” “our”), operating under SEO International FZC, and any individual or business (“client,” “you”) that uses our website, requests a quote, or engages our services. By contacting us, submitting a form, initiating WhatsApp/chat communications, making a payment, or allowing us access to your systems, you agree to be bound by these Terms.
1. Who These Terms Apply To
These Terms apply universally to:
- Clients & Customers — any individual or business engaging our IT support, Google Workspace, WordPress, WooCommerce, malware removal, or related technical services.
- Website Visitors — anyone browsing fixmydigital.ae, submitting an inquiry, or initiating live chat/WhatsApp consultations.
- Business Partners & Distributors — vendors and cloud platforms we work with (e.g., Google, Ingram Micro/Aptec) to the extent their terms interact with services delivered to you.
2. Our Services & Scope of Work
Fix My Digital provides IT support, Google Workspace setup and management, WordPress and WooCommerce solutions, malware and security fixes, payment gateway integration, website speed optimization, and related digital services listed on our website. The specific scope of work for any engagement is defined through our published service descriptions, formal quotations, or mutual discussions conducted via email, phone, live chat, or official WhatsApp channels before work begins.
3. Quotes, Pricing, Payment & Cancellations
3.1 Quotes
Quotes are provided after reviewing details, screenshots, or videos shared by you. If the scope of the issue changes once work has begun (e.g., additional underlying problems are discovered), we will inform you before proceeding and may issue a revised quote.
3.2 “No Fix, No Fee” Policy
For applicable troubleshooting services, if we are unable to resolve the specific diagnosed issue you engaged us for, you will not be charged. This policy applies strictly to the diagnosed issue as scoped; it does not extend to separate, unrelated issues discovered during engagement, or to services explicitly billed on a fixed/project basis (e.g., Google Workspace setup, WooCommerce builds).
3.3 Payment Processing, Late Fees & Chargebacks
Payments may be made via local bank transfer or licensed third-party payment gateways (PCI-DSS compliant). Payments not settled within agreed timeframes may lead to suspension of active services (including Google Workspace accounts) after prior notice to the client. The client assumes financial responsibility for any unjustified chargebacks, payment disputes, or reasonable processing fees incurred as a result of non-payment.
3.4 Refunds
Refunds are evaluated case-by-case. Where “No Fix, No Fee” applies and an issue cannot be resolved, no fee is due. For services already delivered, configured, or confirmed operational, fees are non-refundable.
4. System Access & Client Credentials
To perform IT support and cloud configurations, temporary access to your systems may be required. By engaging us, you agree that:
- Where possible, access should be provided via secondary or delegated admin accounts.
- If you choose to share primary login credentials, you assume responsibility for changing and updating those credentials immediately upon project completion.
- You confirm that you possess the legal authorization to grant us access to any shared systems, domains, or data.
5. Client Responsibilities
To ensure effective delivery, you agree to:
- Provide accurate details, logs, or recordings regarding technical issues.
- Maintain independent backups of your websites, databases, and emails prior to service execution.
- Respond to verification requests promptly to prevent operational delays.
- Maintain active standing with underlying third-party subscriptions (e.g., domain registrars, hosting, or Google Workspace accounts).
6. Turnaround Time & Unforeseen Delays
While we aim to resolve standard email and IT issues within 24 hours of receiving complete diagnostics, resolution times may exceed 24 hours depending on issue complexity. Fix My Digital is not liable for turnaround delays resulting from factors beyond our direct control, including but not limited to third-party dependencies (DNS propagation, Google platform approvals), regional/international internet outages, or ISP infrastructure failures.
7. Third-Party Platforms, Licensing & Distributor Terms
Services involving third-party platforms (e.g., Google Workspace, Ingram Micro/Aptec, WordPress, hosting providers, or payment gateways) are subject to those providers’ respective terms and policies. Clients are encouraged to review third-party terms prior to engagement.
Fix My Digital is not responsible for third-party platform outages, policy changes, or pricing modifications. Licenses tied to annual distributor commitments or fixed cloud contracts cannot be cancelled mid-term without fulfilling remaining payment obligations dictated by the third-party distributor.
8. Intellectual Property & Portfolio Use
Custom code or documentation created specifically for your project becomes your property upon full payment settlement. Pre-existing scripts, tools, or internal frameworks remain the property of Fix My Digital.
We respect client confidentiality. Fix My Digital will only feature a client’s project, name, logo, or case study details in our marketing materials or portfolio with the client’s prior written consent. General, non-identifying descriptions of our work (e.g., service types delivered, without naming the client) may be used for internal reference and service improvement.
9. Limitation of Liability
Fix My Digital is not liable for pre-existing system vulnerabilities, unbacked data loss, or indirect commercial damages (loss of revenue/business interruption) resulting from third-party server downtimes or external failures. Total liability for any claim is capped at the total amount paid by the client for that specific service engagement.
10. Confidentiality
We maintain strict operational confidentiality regarding all client credentials and infrastructure data, sharing information only where necessary to fulfill service provisioning (e.g., submitting reseller licensing requests to Google or Ingram Micro) or as required by law.
11. Termination of Services
Either party may terminate an ongoing engagement with reasonable written notice, subject to settlement for work completed. Fix My Digital reserves the right to suspend or terminate services in cases of abusive behavior, non-payment, breach of these Terms, or requests involving unlawful acts. In cases of non-payment or contractual violations, Fix My Digital reserves the right to pursue appropriate debt recovery or legal remedies available under applicable law.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates. We aim to resolve any disagreements amicably through direct communication first. Where a dispute cannot be resolved directly, it shall be subject to the jurisdiction of the competent courts of the United Arab Emirates, without prejudice to any mandatory consumer protection rights a client may have under the laws of their own country of residence, where applicable.
13. Changes to These Terms
These Terms are designed to remain applicable as our services and business practices evolve. We may revise these Terms at any time to reflect new services, tools, or legal requirements, without needing to issue a separate notice for each change. Continued use of our website or services constitutes acceptance of the Terms as currently published.
